Image Use & Attribution

Image Ethical Use Policy

Policy Application

This policy applies to all image use across The Palimpsest, Nostalgic Confections, Confectionally Yours, Orphicon and affiliated editorial platforms, and related social channels.

Attribution & Source Transparency

– All externally sourced images are credited to the best of our ability.
– Photographer names, dates, publication history, and archival context are included whenever possible.
– Orphan works (images without known authorship after good-faith research) are identified as such, with documentation of all research steps.
– Records of identification efforts, including reverse-image searches, metadata analysis, and archival consultation, are maintained.
– Rights holders are encouraged to contact us; we provide full research documentation upon request.

At Nostalgic Confections and The Palimpsest, we believe every image carries a story — and that story deserves to be treated with care, context, and respect.

We use a blend of original photography, licensed media, archival materials, and historically significant imagery curated for education, remembrance, and emotional resonance. When we feature visual content not created by us, we follow the principles below.

Purpose of Use

– Images are used strictly for editorial, educational, cultural-preservation, and archival purposes.
– No image is used for resale, product branding, commercial merchandise, or direct monetization.
– Visual storytelling here seeks to honor the past, enrich the present, and evoke shared cultural memory.
– All use aligns with fair-use and transformative commentary principles

Scope & Application

This policy governs the use of reposted or referential imagery across The Palimpsest, Nostalgic Confections, and affiliated editorial or social platforms.

It applies to all non-archival images shared for cultural, historical, or editorial purposes and is intended to ensure ethical use, clarity of intent, and consistency across platforms.

This policy does not govern original works, commissioned imagery, or materials formally curated within the Orphicon archive.

Purpose

This policy exists to enable thoughtful cultural and historical reference while protecting creators, rights holders, and the integrity of the project.

Reposted images are used to support understanding and discussion — not as assets, branding, or substitutes for original work.

Guiding Principles

Reposted imagery is shared in the spirit of:

– cultural reflection
– historical context
– editorial commentary
– educational reference

The written work remains primary.

Reposted images may not be altered, stylized, cropped for emphasis, or adapted into derivative works.Images serve a supporting role only.

Definition: Reposts & Cultural Ephemera

A reposted image is defined as:

– An image shared for contextual or editorial reference
– Not owned, licensed, or claimed by the project
– Not altered, branded, or stylized
– Not stored, cataloged, or reused as an asset
– Not treated as part of any permanent archive

Reposts are intentionally ephemeral and non-archival.

Permitted Use

Reposted images may be used when all of the following conditions are met:

– The image supports written editorial or reflective content
– The image appears in its original form
– No branding, overlays, or visual modifications are applied
– The image is not monetized or used for promotion
– The image is not reused across platforms
– Context is clearly provided explaining its relevance
– Attribution is included when known or reasonably discoverable

Reposted imagery is not intended to replace, reproduce, or compete with the original work or its commercial use.

Prohibited Use

Reposted images may not be:

– Treated as public-domain unless verified
– Added to archives or long-term collections
– Used as decorative or filler imagery
– Used in commercial, promotional, or branded materials
– Cropped or altered to remove identifying features
– Adapted into derivative or design assets

Attribution & Rights

– Attribution is required when known or reasonably discoverable.
– All copyrights, trademarks, and moral rights remain with their respective holders.
– No ownership, license, or endorsement is implied.

Removal Policy

Images will be removed immediately upon request by rights holders.

Requests for correction or removal are honored promptly and respectfully.

Editorial Context & Cultural Reference

Reposted imagery may be used within editorial or reflective content when it serves a clear cultural, historical, or analytical purpose. Editorial use may include publication on affiliated websites or social platforms when the image is presented in direct support of written commentary or analysis

Such use is considered contextual and transformative in nature when:

– the image supports written commentary or interpretation
– the image is not presented as a standalone or decorative element
– the image is not treated as a reusable or proprietary asset
– attribution is provided where known or reasonably discoverable
– no commercial or promotional use is implied

This approach aligns with accepted editorial, academic, and cultural documentation practices.

Relationship to Orphicon

– Reposted images are not part of the Orphicon archive
– Reposts are not retroactively archived
– Archival inclusion requires independent research and verification
– Rare historical exceptions may be evaluated separately

Good-Faith Use Statement

Reasonable efforts are made to identify sources and context; absence of information does not imply ownership.

The absence of attribution does not imply ownership or unrestricted use.

When uncertainty exists, the image is not used.

Policy Statement

This project is committed to ethical use, cultural respect, and transparency.

Reposted imagery is shared to support understanding — not ownership.

This policy may evolve as standards, practices, or understanding change.
